Lawyer for expatriate employees

It is not uncommon for a company to send one of its employees to carry out missions abroad. In this case, we often speak of expatriation status. You should know that the concept of expatriation can be broken down into different statuses, depending on whether the worker is covered by French labor law or not. Depending on the mission entrusted to him, the worker may be on secondment or expatriation.

My name is Anne-Sophie Delavaud and I support employees and companies on this legal issue. The expatriation of the employee

Expatriation is often the status chosen by the employer for an external mission, generally lasting more than 3 months. This type of status offers more flexibility, both for the worker and for the company. In this case, the employer has no obligation vis-à-vis social security and the employee is directly affiliated to the social protection system of the country of expatriation. However, the worker can retain his social security rights by joining the CFE (Caisse des Français de l'Étranger). Usually, companies specially recruit an external person for expatriation assignments.

The secondment of the employee

The detached status offers more comfort and generally concerns the position of a high-level corporate executive. The worker is sent abroad for a fixed period, frequently not exceeding 3 months, but which can go up to 6 years. In the case of a secondment, the agent's salary is fixed and paid by the company that assigns him. The employee thus remains domiciled in France, from a tax point of view, and benefits from social protection paid for by the employer.

Membership of the expatriation scheme

The Caisse des Français de l'Étranger remains until now the system that simplifies the formalities of membership and payment of social security contributions. In addition, this fund will ensure specific actions for the benefit of expatriate workers. Adhering to the expatriation scheme is voluntary, but conditions must be met, as stipulated by article L762-1 of the Social Security Code. To find your way around easily, Maître Anne-Sophie Delavaud, a lawyer specializing in labor law in Marseille, can assist you in your steps during the membership process.
